Optimised for scalability and policy-driven data retention, Version 3.7 is the first and only archiving solution to provide comprehensive, integrated functionality to ensure that records pertaining to a specific case or cases are preserved and managed, in line with litigation hold orders and that an auditable chain of custody supports testimony requirements.
Dubbed the Data Preservation Edition, Version 3.7 addresses current legislation in Australia, such as the Victorian Crimes Act (Document Destruction), which includes penalties for deleting documents and emails that are likely to be required in legal proceedings.
Further, new e-Discovery rules being developed for the Federal Court of Australia are expected to impose strict obligations on companies on their handling of electronically stored information and ensuring its availability for commercial litigation. It will require CIO’s to take a more active role in their organisation’s legal affairs. IT now has to balance operational issues whilst acting in a way that ensures the company is compliant with document retention and destruction regulations, such as the Corporations Act 2001 (C’wealth).
"With so much focus on data preservation and strict timelines for discovery orders, companies are starting to re-evaluate their previous technology decisions and are demanding tools that allow them to become pro-active about litigation readiness. Most are also looking to handle more of the process in-house," said David Thompson, vice president of AXS-One Asia Pacific.
"A comprehensive electronic records management system with a feature-rich case management tool is exactly what the market is looking for. It enables a legal representative to pro-actively manage e-discovery requirements and ongoing investigations without having to involve IT," said Thompson.
The Data Preservation Edition also addresses the recently amended (US) Federal Rules of Civil Procedure (FRCP), making it relevant for any company in Australia with associations in the United States.
The AXS-One Data Preservation Edition specifically introduces extensively enhanced workflow-based case management capabilities, improved PST and File System Archiving functionality, enhancements to Microsoft Exchange and Lotus Notes and Domino email archiving modules (including support for Microsoft Exchange 2007 and Notes/Domino 8), significant enhancement to reporting and the introduction of an online monitoring dashboard as well as simplifying product administration and minimising training requirements, by adopting native user interfaces.
