Vodafone to be served class action over network issues

Legal action is being led by Amanda Burkett, a former Vodafone customer

Law firm Piper Alderman has announced plans to serve Vodafone with a class action following years of collecting customer experience stories through its online survey.

The class action is being led by Amanda Burkett, a former Vodafone customer.

“Vodafone is aware that a law firm which is known for promoting class actions plans to announce tomorrow that it plans to proceed with a class action,” a Vodafone spokesperson said in a statement.

The spokesperson said Vodafone has not yet been briefed about the class action.

As per law, Piper Alderman will engage with Vodafone ahead of proceedings being filed, the law firm told Computerworld Australia.

The class action refers to network problems which dogged the telco in 2010 and 2011.

Vodafone Hutchison Australia reported in its preliminary final report on Monday that it lost 443,000 customers for the 12 months ending 31 December, 2012.

In 2011, Vodafone lost more than 375,000 customers following customer service issues and network problems.

The litigation has been in the works for several years, with Piper Alderman putting a call out to Vodafone customers to complete an online survey about the telco's network issues, such as poor reception and poor data performance.

“Vodafone, however, has continued to charge customers on its mobile plans, without providing the service it promised,” the law firm states on its online survey.

“Customers who signed up with Vodafone over the last three years may be entitled to compensation if they were misled into signing contracts or if Vodafone did not live up to its end of the bargain.”

The law firm has stated more than 23,000 people have expressed interest in joining the class action.

In October 2011, the Sydney Morning Herald reported the class action had failed to attract funding, with Piper Alderman looking overseas for funding for the litigation.
